Aluko & Oyebode is one of the foremost telecommunications practices in Nigeria and has developed unrivalled experience in this area of law. Nigeria is a developing and evolving market for the TMT sectors. We actively participated in the development of the new Telecommunications policy in 1999 by the Federal Government of Nigeria. We advised one of the successful licensees at the auction of GSM licences and continue to represent its interests. Our firm also advised some operators at the fixed wireless access auctions.

NCC Issues Commercial Frequency Management Policy, Administrative Procedures and Technical Guidelines
NCC has issued the Commercial Frequency Management Policy, Administrative Procedures and Technical Guidelines (the Frequency Management Policy). It would be recalled that NCC had earlier made available a draft of the Frequency Management Policy to stakeholders for their input. The objectives of the Frequency Management Policy are:
• To regulate the use of spectrum as an instrument for developing the nation’s telecommunications industry
• The promotion of competition in the assignment of frequency
• To achieve optimum pricing of spectrum in order to discourage waste and speculative acquisition
• To generate revenue for the government
• To ensure the equitable allocation of spectrum
The Frequency Management Policy comprises of two parts. Part I provides for the management functions of NCC; a frequency pricing policy; the methods for frequency assignment; and, a frequency sharing policy. Part II lists the administrative procedures. The technical guidelines which contains the frequency utilization plan and licensing time frame is in Annex 1.
