The Firm has a vibrant Shipping Law Group consisting of partners
and associates with a wide range of experience and expertise in
Admiralty and shipping laws. We work with ship owners, operators,
charterers, brokers, insurers, P&I Clubs, banks, shipyards and
traders.
Our non-contentious work covers banking and finance, sale and purchase,
shipbuilding contracts, commodity contracts, registration and ship
management agreements.
On the contentious side, we get involved in all types of marine
and international trade related disputes, including bankruptcy and
insolvency, and we have specialists in all aspects of maritime accidents.
With an extensive overseas network, we have a track record of establishing
close links with clients from all parts (and ports) of the world.
The Shipping Law Group works independently and, where appropriate,
in conjunction with the General Litigation Department on all kinds
of "wet" work and contractual disputes, which can arise
from such casualties. The Group attends and advises on collisions,
groundings and other major casualties including fire and explosion
and has expertise in successfully managing serious marine incidents.
We advise all sectors of the marine market on collisions and groundings,
fires, total losses, salvage, jurisdictional issues, oil and other
pollution, limitation and technical disputes of every nature including
unsafe port, progressing matters either to settlement, arbitration
award or court judgment as appropriate. The group assists clients
by instructing and liaising with foreign lawyers and coordinating
multi jurisdictional disputes. It advises upon, and acts in, the
arrest of vessels and assets worldwide.
The group also provides high quality legal service when dealing
with the enforcement of awards and judgments worldwide and has a
proven track record of assisting all parts of the shipping industry
with its extensive range of legal solutions, skills and experience.
We act for the ship finance departments of certain banks on a retainer
basis and assist in the drafting, negotiation and, when required,
registration of financing and security documentation arising from
straightforward and also more complicated ship financing transactions.
We also undertake specific points of research for such banks in
order to assist them in improving the services they provide to their
customers.
When acting for ship owners, we advise on the intricacies of shipbuilding
contracts, refund guarantees and finance transactions, usually involving
different jurisdictions. We hold a wealth of information and know-how
on legislation and ship registration in different countries, which
proves very useful when advising on cross-border transactions.
We also act for traders in securing the release of their cargo when
a vessel has been arrested, and in pursuing other claims, which
may arise from the carriage of their goods by sea.
